As fundamental rights in art.21 imposes restrictions over freedom of human life & body therefore Aruna Shanbag, who had been lying unconscious
since last 37 years,had been deprived of Wish Death or Euthanasia by the court.This verdict gave birth to an unending debate.As per provision of article 21 of constitution "no one can be deprived of his right of liberty to body & life unless permitted by law" But people are committing suicide,which could not be restricted by law & law enforcing agencies.................... It means,if we go to law for seeking permission of wish death ,answer'll be NO...but this legal imposition cannot stop every day increasing suicide cases.
Now question arises,what death is...........in my perception termination of consciousness is Death.But semi consciousness,when other organs ceases
to work but heart & brain continues to work & participate in process of thinking...this state may be called unconsciousness but not death .....Same was the condition of Aruna Shanbag in Mumbai & Mr. Mescarhance in movie guzarish.Therefore now we should think that what about those who are under incurable state since a long like Aruna & others.It's true that mentally they are not dead, their brain is functioning & this functioning is the deciding factor of human activities but what to talk of such consciousness ,where one cannot put into exercise his wish for a period of more than
three decades.Is n't it a proper ground for granting death to a person paralysed & bed ridden for years together,and gradually creeping towards his
ultimate end.The person who reached to such an poignant state due to an criminal act,is it not the duty of state to own the responsibility of that mischief & failing in providing protection,Govt. must grant permission of euthanasia to him.
Our constitution grants us a right to live with human dignity,but should this Govt. not grant us a right of dignified death too.A person reached in VEGETATIVE STATE is not living his life rather he is living his death......& to cut short his agony he should be granted permission of Mercy Killing
.We may call it justice of nature...truely
